never married father of my child and i have custody question

I am the mother of a four and a half year old

My son's father and I have never married

And we do not live together.

My son's father lives in his beach house

I rent a another house that his father owns for $700 a month and pay his father directly

We have agreed verbally, not legally, on joint custody

Our child sees his father once or twice a week and has for

the last four and 1/2 years, usually with me present at my rental house.

maybe 5 or 6 times my son has spent the night at his father's beach house

We split our son's college fund, each paying 140.00 monthly

I teach full time and pay for my son's medical insurance, clothes, food, dental care, extracurricular activities, vacations, etc. I have done this since the day our son was born.

My son's father has been unemployed, has seen a counselor for depression and has been off and on medication for this

problem over the 4 1/2 year period.

Throughout the 4 1/2 years, my son's father has been verbally abusive and threatening, but has never hit me or our child. In the last few weeks, he has escalated in his

verbal abuse and threats of hurting me in front of neighbors, family and friends.

1. What do I do First to be sure he does not get custody?

Until legal paternity is established you and your

son have no legal rights. A court proceeding maybe required.
