Legal Question in Family Law in Florida
I've been married for fifteen years. I recently discovered my husband was having an affair with a much older woman and sleeping around with escorts as well. He does not have any knowledge I know about his liasons. He is real estate professional. Our million dollar home is in the process of forclosure because of irresponsible transactions on his part, he has not paid our taxes in four years, our bank accounts were wiped out by the IRS and our home is also levied. My credit is ruined to boot. He works under a relatives license in order not to be discovered by the IRS and deposits his earnings into the relatives bank account since we dont have one. This relative pays our bills with our money (from the account in their name). I don't have access to anything except fot the little he gives me here and there. I feel trapped. Did I mention we have three kids together and I'm a stay at home mom. I want a divorce! I just don't want to be left penniless and homeless with my three children. What can I do? He makes over $300K a year and he's in control! I know florida is a no fault state. He says If i ever left him he would not owe me a dime since I cannot prove income and he's right because technically he doesn't make a dime his relative does! Even our cars are in the relatives name. I am desperate. What can I do? How do I obtain a divorce from this person?

You will need to hire an attorney. I suggest you check around and find one that has years of experience and the ability to locate funds. Your relatives' records can be subpoenaed and there needs to be an explanation as to how they have amassed all these funds and assets.
Florida law is very specific as to the definition of income when making a support determination. Even though your husband goes through great lengths to hide his income, you should be able to determine his actual income through the discovery process. Also, in Florida, marriage carries with it an ongoing duty to support. The statutes allow for the courts to order support during the pendancy of the divorce. It sounds like your situation is more complex than most and you would probably benifit from hiring an attorney. I hope this helps and good luck.
