Legal Question in Family Law in Florida

my ex and I were never married. he filed recently file for custody/timesharing. I just got married,moved to MI,received a pick up order for the return of the children. what should i do? i have 20 days to return the children(to their father),who have lived with me since they were born.

Even though you were never married, if there was ever a court case regarding the child you have in common or if one is pending, you needed the father's written permission or the court's permission before moving.

If there was a case or if one is pending and you moved without permission or court approval, the court will order you to return the child and this action will reflect negatively on you. However, all is not lost. Make sure you have strong grounds for wanting to move and you are able to show how the move will benefit the child. The court will also look to see how the father will able to see the child and maintain a relationship with the child after your move.

Meet with an attorney. Hire Florida counsel to defend against the pick up order. But, unless the court directs otherwise, return with the child within the time period and then formally request Relocation.
