Legal Question in Family Law in Florida

i am married but separated however due to economic climate we both live in same house at present leading separate lives. He is hoping to move out by March 2013 at latest. Someone has advised me to get a deed of separation and someone else has told me to get a separation agreement for the children. What is the difference and what would be more relevant to my circs please?

"Deed of Separation" does not exist. You can file for separation however you may as well file for divorce. Divorce is easier. Contact my office for free consultation 727-446-7659.

The parties can have a written separation agreement prepared to cover custody, visitation, child support, alimony, distribution of marital assets etc.

There is actually no legal separation in Florida. You can prepare documents but I doubt that they would hold up in court. I suggest you go ahead and file a Petition for Divorce and outline your marital agreement. It is much cheaper and can be done within a week for a divorce. If I can be of assistance please contact my office 904-997-1031
