Legal Question in Family Law in Florida

I have been married for 2 years and 11 months. My husband is verbally abusive, which I can't prove. I would like a divorce and since he did not own anything when we were married do I have to leave him anything. The house is in my name.

Anything purchased after the marriage (with some exceptions) is marital, regardless of how titled. If the house was purchased before the marriage and you never added him to the title then the house is not likely marital property. However, if it was improved during the marriage, the enhanced value is a marital asset if the source of improvement was marital funds or effort. A marital asset is subject to division upon dissolution of the marriage.

If the house was in your name prior to the marriage then it is non-marital property. Contact my office for free consultation 727-446-7659.
