I have been married 12yrs and Ilive in florida. i Just recently found out that my husband fathered a child out of wedlock in 05. He is not working and they have garnished his unempolyment which is half of it and will run out of unemployment money soon and now they say he owes retro pay of 8,900. I have a stable job and have two kids will my check be garnished because of him not working and having this child.

No. Your check will not be garnished. Your husband could possibly lose his driver's license, face jail time, etc for not paying his support obligation once his unemployment runs out. He should petition the court to reduce his child support since he is unemployed. In the meantime, do not file a joint income tax return with him as it can be garnished. File solo!
