what if some one marries without being divorced by mistake

It's technically a crime, but it's very rarely prosecuted. It actually happens more often than you think.

When this happens, the second marriage is no good. It's a "nullity." It never legally happened. The divorce has to happen on the first marriage, then the couple in the second marriage is free to remarry if they want.
