Legal Question in Family Law in Florida
I am in the middle of a divorce and a custody fight. The judge that is hearing this case has given temporary custody to my abusive soon to be ex, and kicked me out on the street. This judge has also allowed my husband to take my son out of state and dump him on the grandmother. I have not been able to see my child in 4 months. My husband has repeatedly violated the Florida state standing order as well as the judge's orders. But the judge doesn't seem to care. I have been trying to do what I am supposed to be doing, but I am getting screwed. Can the judge legally kick me out of my home with out proving me to be an unfit mother?? Please please help.....

The standard for "kicking [a person] out" of their home is not that they be an "unfit mother," so yes, the judge can kick you out without anyone having to prove you are unfit. If the judge hasn't followed the proper standard, you can appeal. Better yet, to find out what the standard is, and maybe to stop losing so many battles in your case, why don't you hire a lawyer?
