My husband and I have 2 homes.

Will I be able to live in the home that is cheaper to live in?The home

that is less is in my older sons name

also with survival rights. The cheaper home is also rented out,but the renters know they may

have to move and they are okay with that.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

I have to presume that you are suggesting that you want to file for divorce and request one home. It is very possible that the court will agree to such a division of the property if the parties are unable to do so amicably. You should retain counsel who can work with you towards reaching an agreement to avoid litigating this in court and to help resolve all other matters including reasonable child support, if applicable.
