minor guardianship

my husband's sister left custody of her child to us, but did not leave us as her legal guardians. her ''real'' father is alive, but abadoned her when she was two. we are trying to get a passport, but are unalbe because of the legal guardian issue-where do we legally stand? thanks

Until you are appointed by the court you have no authority.

You don't say whether either parent is available to apply for and get the child a passport. Assuming that is not possible, you will need to get an attorney to try to get you through this tangled web.
