Legal Question in Family Law in Florida
Mize Case
I was divorced in Florida during early 1997, and my children have been residing with me in Florida. (Same residence since 1987). There have been no significant changes in living conditions. I am primary custodian with shared parental responsiblity w/mother. Mother is now (after 3 years) seeking child support, change of residence (to another state) and back child support. How can MIZE case help determine where the children are better situated? Mother has paid me no support since divorce in "97.

Re: Mize Case
Your ex is not entitled to child support because the children have not resided with her since the divorce. You on the other hand can file a Motion for Child Support arrearages (back support). Since the children reside with you, your ex can move where ever she wants. It would then just be a matter of visitation with the children. Who will pay for the transportation etc.
