modification of a temp. support order

my ex was ordered to pay temp child support in 1997 based on unemployment and it has never been modified, he got a job shorty after the order and had ability to pay more and didn't. can i retroact any modification to 1997?

No, you can only go seek retroactive child support if he is not paying it and can only go back 24 months from the date of the Motion for Contempt or Supplemental Petition for modification of Child Support. In your case, you can't go back at all. You can just seek to modify it upwards from this point forward. Sorry!
