Legal Question in Family Law in Florida

My Mom has been with a verbally abusive man for almost 7 years. They never married. They have split up now and they own a property together and both are equal partners and both names are on the mortgage. He is threatening to force her to sell. she does not want to because d/t the market, she will lose her 80,000 investment. He does not care about losing any money. Can he force her.

Hello:

Since they were not married, Florida law regarding real property will control this rather than chap. 61 (re: divorce). Basically, she can buy out his share and keep the property. They will probably end up litiigating or negotiating over the fair market value of the property. If my office can be of any assistance, let me know. Tom Rosenblum
