Mom's domestic violence with live in girlfriend

My livein boyfriend is seeking court ordered visitation with his child born out of wedlock. He pays c.s. on time, he takes the child to the dr, attends school functions and exercises day visitation whenever the mother permits. Basically, he is a great dad. He wants overnight/weekends, etc established to avoid being at the mercy of the mother's moods and/or social plans when trying to see his daughter. The mother claims she doesn't want her child in our house/around me due to the history of d.v. between me and her. We had mutual restraining orders based on her repeated physical attacks on me where I defended myself. She attacked me in front of our children.

No criminal charges were filed and the restraining orders were dropped at my request due to her own actions.

She claims she will refuse visitation in our house/around me based on our d.v. history and that the child is ''afraid'' of me. How much merit will the claims hold when the judge makes his decision?

It depends on testimony and other evidence. It sounds s though the father is doing what is should be doing. Tell him to keep it up. As for the issue between you and the mom, your boyfriend's attorney needs to show that the child's exposure to you is not against the her best interest. Combined with her interest in a closer relationship with her dad, he has a good chance. The age of the child may also be a factor...
