Mother Giving up legal rights

if my husband is placed on a child's birth certificate and signs the certificate and the mother signs over legal rights to not have anything to do with the child, like many men do.Would he then have full custody of the child and would I be able to become a legal guardian? What kind of legal issues would have to be taken just for her to give up legal rights? The mother is now pregnant with the child and will not be able to care for it when it is born.We are family friends and would like to give this child a loving and safe home.
