can a mother leave state with her child

I am a mother of a 3 year old, I want to move to another state, I was never married to my child father, but he is on the birth cert. He does not pay child surport. Can I get charged for kidnapping my son if I moved to another state with him?

You should not move from the state without a child custody order in place. The father has equal rights as you to the child. If you move without the court's permission, you could face severe repercussions.
