Legal Question in Family Law in Florida

My mother recently passed away and had unfortunately remarried less than a year ago, and her now husband is witholding EVERYTHING from our family, including baby photos and childhood pictures. Can he legally withold things from our childhood from things over 20 years before he even met my mother?

did your mother leave a will? If she did not, then you are entitled to one-half of her estate. the statute if very clear: 732.102(3) If there are surviving descendants, one or more of whom are NOT lineal descendants of the Surving Spouse, one-half of the intestate estate goes to them.

You would have to file a probate case then force him to deliver the photos etc. Also the probate would wind up the affairs of the deceased. Contact my office for free consultation.
