The mother of my son who has hypo plastic left heart syndrome has admittedly not taken him to the hospital when she believed he needed to go because she said she didn't have ride multiple times every time I get to see him he is covered in bug bites I have documentation of all of this is this considered neglect

So what's your question? Should you take the mother back to court to gain primary timeshare because your child"s health and safety are in danger? Yes, assuming he needed to go to the hospital for a serious reason and not just to use the hospital as a primary care facility, you should take her back to court.

It could be considered neglect. If she is not caring for the child's needs then you may want to go for custody.
