Legal Question in Family Law in Florida

Motion For Default

How long does it usually take to get a hearing after Motion for Default/Default granted has been filed? Is there a waiting period or just upon availability? (Osceola County)

Re: Motion For Default

It depends on the type of hearing you want. If you want an uncontested final hearing, you should be able to get a hearing date within 60 days, but courts are extraordinarily backed up right now because of the budget cuts. There is a 30-day waiting period in divorces if the other person was physically served. There is no waiting period if you served by publication.
