I want to move to Florida to get out of a horrible relationship. I am pregnant and needing to know if the courts will give the father half custody if he remains in Texas.

If you deliver your baby in Florida and reside in Florida for a period up to six months, the Florida courts should have jurisdiction over your case. As far as timesharing (custody), when the papers are filed with the courts to establish timesharing and paternity you will have to make an argument for your child's best interests before the Judge and the Judge will ultimate decide what he thinks should happen for your child. If you let the Judge know about the dangers of the relationship and why father shouldn't have 50/50 custody then really can't tell you how judge will decide depends on arguments presented and ultimately is up to the Judge. The big question is best interests of the child.
