Can I move out of state with my daughter before my husband and I are divorced?

You can but I would suggest you file a petition for relocation first. Otherwise, he will file for the return of her and then it just gets messy after that.

The Florida legislature changed the law a copule of years ago. In order to be safe you need either his written agreement to the move or a new court order. If this is just for a couple of weeks for a vacation you do not need a court order or permission.
