I have moved out of my house, but am still married, if i buy a home is it marital property? I am in the process of divorcing.

Yes. Unless there is a separation agreement in place, the date when the Petition for Dissolution is filed is the cut off date for what will be determined a marital asset. As such, if you purchase the home before the Petition is filed, the home can be deemed a marital asset to be divided regardless of how it is titled.

Yes it will be. I agree with Ms. Hall however, not knowing your financial status will also make a difference in the split of assets. Such as are these marital funds you are using to purchase the house and can you prove they are not. I suggest you rent until you get your petition filed and matters settled.
