Legal Question in Family Law in Florida

If you have an MSA and your ex retires early(55yoa) and you get permanent periodic alimony,and you make 1000per month and you have a QDRO that awards you your part of that..If the ex asks for a modification of alimony will the judge do a modification? He can return to the state to work after a short period and start a new FRS retirement account..He only retired to stop paying alimony...If I can show the judge his potential of a good income from being a pastor of a church or his returning to the state will the judge modify the alimony???PLEASE HELP ME !!!!!!!!!!!!!!

Whether a court will amend or modify a marital settlement agreement depends on petitioner showing the court that since the court order there has been a significant change in circumstances to justify the modification. A substantial change in income or living expenses or other change must be proved in order to modify the modification. Advice: discuss with an experienced attorney the details of the supplemental petition procedures and legal requirements, and consider legal options.
