Legal Question in Family Law in Florida

My niece is 14yrs old. She's been staying with me off and on every time her father (my brother) goes to jail. She is already behind a grade in school because of her father's stupidity. Each time he goes to jail he becomes a so call "new man" but he ends up going back to his drug and alcohol ways which leads him back to jail. he just got out of jail and wants to take my niece back again as usual. Well, this time around my niece does not want to go back with her father. Is there any way or a law that gives my niece the rights to stay with me or anyone other than her father? I do not work, I am a full time student at UCF. I get support by the father of my kids. but she does fine here with me. I would like advice on what I can do to help my niece. thank you...
