Legal Question in Family Law in Florida
Non custodial parent has not seen child in over four years. Visitation order was oin affect for every other weekend. He showed a few times and then stopped coming. I had a restraining order against him at the time. i found out he is in prison for ten years for burglary. He has a long criminal history with domestic vionece for hitting me when we were together. He owes but has never paid child support. I would like to move out of state in a few years but i am concerned when he gets out he will fight to see his child. He has not shown any concern nor tried to contact me in years. What rights does he have once he gets out or what should i do so he does not try to cause problems for my family?

Even if the judge allows you to move, he will still have the right to see his child. Given his history, you may want to speak with a Florida lawyer to attempt to have his rights modified in such a way that he no longer has rights to visitation.
How old is the child?
A Supplemental Petition for Modification of Child Custody, and For Leave to Relocate should be pursued.
