Non Custodial parent moving from Fl to NY
What are my rights for visitation as the non cust. parent since I am voluntarily moving from FL to NY? It is only fair that I be responsible for any travel expenses and continue paying child support, but do my court ordered visitation rights still stand or am I forfeiting some of my rights? I am a proud and responsible parent and want to do my best to continue my relationship with my son even though I fear his mother is trying to convince him I am abandoning him. Please help, I'm at a loss!

You'll obviously have to come up with a new visitation plan, and you may have to go back to court to do that. Moving happens a lot, so judges are used to it. The new plan will probably include extending your time in the summer and maybe giving you both spring and Thanksgiving breaks. You are right in that you'll probably have to pay transportation expenses.

Hello: I just read your question and the one response. If you are in North Fla., our jurisdiction has a Court Order that provides a general visitation plan for parents that live more than 365 miles away. I believe this Order and Fla. Statutes allow for the Court to split costs for transportation for the child(ren). If you need any help in North Fla., give my office a call. Take care. Tom Rosenblum
