Non Reimbursed Medical and Dental
In my divorce decree it states that I am responsible to pay half of all non reimbursed medical and dental bills. My ex just recently got braces for my two girls (12 & 9) without my knowledge and now she's demanding that I pay her $3500.(I currently live in OH and she resides in FL) My ex sent me paper work requesting that I pay her 150 a month.I already pay her $955 for child support and I told her that I couldn't afford that specific payment amount. My ex just filed a motion in court asking for this money to be taken out of my paycheck. She cited that I refuse to pay for my obligations. I never told her that I wouldn't pay her for the expense and at one time I even offered to pay for it direct through my flexible spending plan. However, she refused and wants to be paid direct because she claims that she paid the $7000 dollars up front. Yet, she won't send me the name of the dentist or the bill in order to verify the cost and etc. What are my rights? Should I fight her in court?

There are several issues here:(1) you are entitled to a copy of the bills;(2) whether you pay her directly or pay the providers might have been worked out in your dissolution agreement; (3) if you did not refuse to pay the bills and she didn't give you reasonable time to do so, the action may not stand; (4) a judge would more than likely appreciate the efficiency and money saving possibilities when using your prepaid plan. I would certainly mention all of this in my response and at hearing. I would also ask the judge to have her consult you before such a large expense. This is not unreasonable as it is not an emergency medical intervention.
