On their own no, this usually requires a court order. Contact my office for free consultation. 727-446-7659.
In order to change court ordered support. They non-custodial parent must file a supplemental petition to modify support or any other changes that involve time sharing. They cannot just refuse to return the child.
Unfortunately, it is possible for them to do this. They can not do so without legal ramifications.
If they are refusing to return the child, you need to file a Emergency Verified Motion for Child Pick-Up Order. A form can be found at http://www.flcourts.org/gen_public/family/forms_rules/941d.pdf
You should also contact a family law attorney in your area to discuss your options.
Court Judgments and Orders are supposed to be followed.
A Motion to Show Cause/Contempt/Enforcement should be pursued.
If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a do over if things go badly.
