Non-married custody question
My daughter and her ex-boyfriend had a child together 3 years ago. They are no longer together and the issue of visitation is becoming a problem. The father drinks, does drugs but according to him not when he has his son - this is questionable. My daughter would like to withhold visitation until we can contact an attorney to settle visitation, custody and child support. Does she have the right to keep him from seeing his son until then? He has been paying $75 per week when he has the money - at this point he is about 6 weeks behind. This is not court ordered just something he felt he should do. She has been fair with visitation up to this point - usually one overnight during the week and another overnight stay on the weekend. Any info would be greatly appreciated.

1. Paternity should be legally established.
2. If the parties can work out visitation, custody and support it should be memorialized in an agreement. If not, a court order may be necessary.
