Legal Question in Family Law in Florida

Obtaining Parental Rights For Daughter

In 1992 I met a woman and we ended up having a child together. I later found out she was married. They had seperated for a short while then got back together. I was not aloud at the birth and the husband had signed the birth certificate knowing he is stirile (not proven, I think)I lost all rights to my daughter. She let me see her for the first couple years. The mother later devorsed the husband and hit him for child support and me. I gave it because she is my daughter and have DNA papers to prove it. My question is I want my rights back as the father and the ex off the birth certificate. I want custody of my daughter. She is 8 and wants to be with me. She knows I am her father. The mother is using her for money from both her ex and me. The ex has a court order for me to stay away or the mother will go to jail and my daughter is orders to remain in that county. I want my daughter and her not to be a form of control.

Re: Obtaining Parental Rights For Daughter

The message indicates that the ques. pertains to both FL. and PA. I do not know how FL law works. In PA, there is a presumtion that a child born of a married women is the child of the husband. There are some ways around that presumption but they are narrow and I would need more information. If you would like to discuss this matter further, please contact me.
