Legal Question in Family Law in Florida
Oct. 22, 2009 my spouse moved out after 14 yrs. of marriage. We have an 11 yr. old daughter together. We are still residing here, and he lives with his mother. He is still paying all but food. Mortgage is in his name, bought after we were married for 10 years I believe he should continue to pay still since he abandoned us and was considered the head of household and breadwinner, as I only work p. t. Shouldn't I get half of the house if we sell it AND child support and alimony? Thank you Elise.

You're right that you should get half the profit on the sale of the house, child support, and probably alimony. You may be right in that he'll have to pay the mortgage (if a divorce judge orders it) while you live pending the sale of the house, though he'll probably get extra money out of the sale for paying your "rent" for you. You need to go get a full-time job now.
Hello:
There is too much to explain here about Fla. law on the issues involved given your facts...alimony, equitable distribution of property and child support. If you like researching , you can google Florida Statutes and scroll to chapter 61 which covers Dissolution of marriage. You should also have a consultation with a lawyer who practices family law.
The lawyer can advise you about the law on the issues and, just as important, what the procedures are once a case is filed. If my office can be of assistance, please give us a call. Tom Rosenblum
