Legal Question in Family Law in Florida

What happens when you owe past child support?

I know these friends of mine..the guy owes past child support but is paying almost 600 a month now. Yes, he does owe alot in the past but for the last 6 or 7 years he has paid what he was supposed to. Now the ex wide keeps threating him of taking him to jail for what he owes, she threatens him every time they get in a fight. Can he go to jail over that? Can they arrest him for child support that wasnt paid in the past even though he pays it on time now? If this makes any sense please let me know your answer!

Re: What happens when you owe past child support?

If he has paid timely for several years and is paying an amount based on his ability to pay and the needs of the child, a court is not likely to send him to jail. Courts do this only as a last resort to force payment. Jailing him would not be in the best interest of the child or children and is quite unlikely. He is advised to consult with an attorney who may be able to modify the past arrearange based on special circumstances.
