Ownership of assets

My wife and i are going through a divorce. We have a two year old daughter together. I have one vehicle, she has the other. Both are financed in my name. I have been paying her car note and insurance and deducting it from child support. She can not get her car financed in her name. Are there any legal issues with me taking possession of her car back. She lives on her parents property and they have an extra vehicle and told her she could drive it.

Legally, unless a court order says otherwise, you could probably go take the car. But, remember that, under divorce law, you both own the cars, regardless of how they are titled or financed, so don't sell it.

As a practical matter, though, taking the car from your wife and deducting payments from child support are the kinds of things that make judges really mad.
