Legal Question in Family Law in Florida
I paid my retainer fee to my attorney for a Dissolution of Marriage in May 2010 and nothing has been done and I have called 3 times and cannot get a return call. The question is can i get a portion of my retainer back so I can hire another attorney and if so how do I go about it?

If in fact nothing has been done, no papers filed or drafted, no phone calls made, you should make a formal request for a refund of all attorneys fees. If still no response, you should contact the Florida Bar for further instructions on filing a bar complaint.
Also, be sure to put your request in writing before mailing/hand-delivering it. Keep a copy for your records as well.
You might want to look at the contract you signed with the attorney. Was this only a portion of the retainer required? Is the retainer refundable? Did you supply the attorney with the requested information. Really need more information as to your circumstances. However, you should contact the FlaBar.Org to file a complaint if you can not get the attorney to respond to your phone calls.
