Legal Question in Family Law in Florida

Parental rights issues

My ex and I have a daughter...I have residental custody and we both have shared parental rights...His current wife insists on being in on all the decisions to be made with my daughter...She will not let my ex have any say alone...This has caused some major problems...What are my rights and can I insist on anything??? I do not have a problem with him discussing things with her...but when it comes right down too it...I think the decisions should be strictly between he and I...

Where do I stand?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

While she has no legal rights to make any of the decisions, as a practical matter, the child does stay with her in her's and your ex husband's home and thus she is involved in the child rearing process. You should try to find a way to live with her involvement and appreciate her concern so long as she does not overdue it. If it becomes too much, then you will need to have your attorney take the appropriate action in the court.
