13 years ago I got pregnant by a date rape, I did not press charges and I ended up getting married to another man who put his name on the birthcertificate, knowing he was not the biological father. I recently told my son about his biological father and he has met him the biological father wants a paternity test. My question after getting the test and he is the biological father, does he then have parental right

If he is determined to be the biological father by DNA, he could file a claim in the family court to assert his rights as a parent. It would then be up to the judge to make a determination whether or not to grant his petition or motion. Of course, if he does, then the father would be responsible to pay his share of child support for the child.
