Legal Question in Family Law in Florida
Parents die, leave children, house and no will
My aunt and uncle both passed away, leaving 3 children behind and a house w/ 2 mortgages. No will was found. Agreeable to all parties, my aunt's brother was named guardian, but not agreeable and not sure how it came to be, my aunt's sister has been deemed executor of estate (how can this be if there was no will?) and has plans to have investors buy shares in the house for a possible future profit benefiting only herself and the other investors(not the kids).
Also, a trust was set up for the kids through the local church. We just rec'd a letter stating that all this money has been taken out by the same brother and sister to reimburse themselves for various expenses.
Is what they're doing legal and do the kids have a say in what happens to their house? Do we have a say (paternal aunt and cousin to the kids) in any of it? I want all of this money to go to those kids who have nothing left of their parents but a house full of memories and a trust fund to help pay for their parents funerals. Please help. I don't know where to turn!

You failed to indicate where this is pending. Someone needs to go to the court file and review the matter to see if it is being handled properly.
