Passport application for a minor
My brother in law needs to apply for a passport for his 12 yr old son to go on vacation in Europe. His ex wife is refusing to sign the application without giving any reason other than its too much trouble. They are divorced and have joint custody. He has been told that there is a State Department form DS 3053 that can be used in these circumstances if appropriately notarised ? Does this sound right ? Many thanks for your help

This is the proper form to use, but the wife will still have to sign in front of a notary. http://foia.state.gov/FORMS/Passport/ds3053.pdf
In general, as it is joint custody, if she objects to the child leaving the country, he cannot go. There are some exceptions but they are very fact specific and may involve court action.
