My cousin�s ex-husband recently placed the Suffix ''Jr.''on his 3 yr old son�s name. They have the same first name but not the same middle initial. He was told not to do this because on one occasion the ex placed Jr. on a child support check and my cousin objected because he is not legally a ''Jr.'' and what I mean by ''legally'' it does not say Jr. on his Birth Certificate. She thought it was done in spite and because her new husband who is ''really there'' for the 2 boys. So he decided to continue the drama and placed ''Jr.' on his US passport that he recently applied for and received. I advised her that do to new Laws like the Patriot Act that the boy would run into ID issues when applying for things like a license, back ground check for employment and all the other things in life where ID is requested/required.(the boy is 3). I explained to her that the child might experience problems if his name on his Birth Certificate does not match his official US passport, is this true?Also,1. If it is a problem,how serious is it?2.Will the passport have to be changed?3.If the ex wants to keep the passport with Jr. will he have legally change his son name?4. If someone wanted and officially change their name how much does it cost?

Hi:
As long as someone is using a different name then on their birth certificate and it is not for fraudulent purposes then it is legal.
That being said in the post 9/11 days with the Patriot Act, etc. it is wise thinking to have all of the ID documents consistent.
Rather than going through the procedure of name changing, perhaps you can have a new passport issued.
