Legal Question in Family Law in Florida
Paternity Fraud
I am married to a man that has one child from a previous relationship. This child is 30 years old. My husband has a good relationship with his son now, but for years it was rocky due to the behavior of the child's mother.
A few months ago my husband took his son's side in an argument with his mother. The mother blurted out: ''He isn't your kid anyway. Now don't you feel stupid for paying child support.'' She said other things which are unprintable.
We got DNA testing back and the child is not his.
My husband is upset and very angry, because she lied to him and put him through heck for years. They never got a paternity test (they were in their teens when the child was born).
He was told that everyone in the Mother's family knew she had lied about paternity, because she bragged about getting child support.
We also found out that she told the child's real father about his exsitance and got money from him too. It wasn't court ordered though. The real father was under the impression his son wanted nothing to do with him.
This is not the first time the mother has committed fraud. Is it possible to sue the mother for fraud and a return of since my husband is not the father? Her son wants to sue her also.

Re: Paternity Fraud
Yes, I doubt he could go back more than 6 years. He should have had a test done and not taken her word.
