Is their a family law statue that automatically gives up paternity rights after so many years????

No. Regardless of the length of time, it is necessary to file a Petition for Termination of Parental Rights. A court will hear the Petition and listen to all testimony supporting the filing. The spouse would be given and opportunity to argue otherwise if he/she chooses.
