Legal Question in Family Law in Florida

I am paying child support to my ex-girlfriend. I live in Florida and she was living in North Carolina. I just recently found out that she has moved to Pensacola and is not playing music gigs and making cash under the table. But she is not reporting it. I have proof that she is playing at bars. I have never met my son because she came to me last year telling me I had a son. I have been trying to meet him but she refuses to have any contact with me. I am in the military so I can't go to court at this moment due to a deployment. I eventually want to get full custody of him once I establish a relationship with him. My wife and I have a daughter of our own, both have stable jobs, own our home and can provide so much more for my son than she can. She is living in government assistance housing with 3 boys living in 1 bedroom (he would have his own with me) and works in bars all the time. I don't know who my child is staying with while she is working. Once I get home I am getting a lawyer to try to gain visitation, then eventually some time sharing then hopefully get him with me. I just want what is best for him and know that she can't provide for him like I can. I am just looking into what steps to take now about her not reporting money and if this issue can help me gain some kind of custody of my son.

Once she moves down here for 6 months then you can file for custody, you have a good case.

Hello: It does sound like you have a good case to get custody of your child. The case may need to be filed in Escambia County if they continue to live there. If my office can be of any assistance in Jax. pls, give us a call. I have been in practice for more than twenty years and have handled numerous family law cases. Tom R.
