Paying Child support after 18 years of age.

Cort case held in Florida.After my Son turns 18, do I continue paying support if lives at home while attending College.I was never married.I live in South Carolina.Mother and Son live in Michigan.I have always payed support.Was told it was all going to a School fund. My Son turns 18 this Nov,2001. His Mother is saying she does not have money for his College. Mother is married to an attorny who owns his on Firm and does very, very, well.Thats why my support was going in School fund.

Unless your Final Judgment specifies otherwise, you have no financial obligation to your children after they each reach their 18th birthday.

It is strictly dependent upon the terms of the final judgment. You should review this judgment carefully. There is not a set law regarding entitlement to child support after the age of 18. Each case is determined upon the merits and much depends upon whether or not there may have been an expectation of a college education for the child based upon the educational levels of the parents.
