Legal Question in Family Law in Florida

permanent alimony

In my recent divorce after 26 years of marriage, I was granted permanent alimony until death or remarriage. My husband has threatened to take it back to court if I live with another person irregardless of sex saying that my expenses will be reduced and therefore so should alimony. I had never worked in my married life and he currently makes well into the 6 figure salary. Can this be done and if I relocate to another state, will it make a difference?

Re: permanent alimony

Permanent alimony can be modified upon a substantial change of circumstances. What is "substantial" is based upon the sound discretion of the judge. A roommate could conceivable constitute a substantial change based upon reduced expenses, but that seems unlikely. Also unlikely is a substantial change based upon your relocation unless you relocate to some place where your living expenses are drastically reduced. However, there are no guarantees, and if the judge finds a substantial change, he is unlikely to be reversed on appeal.
