Legal Question in Family Law in Florida
Personal and Death Threats
If someone sends a text message to another person stating that they wish the person would end up in a terrible car accident and die slowly and painfully, is that considered a death threat? What is it considered, and what course of action can the receiver of the text messages take? Also, what are ''name calling,'' text messages considered, when the words ''bitch'' and ''nazi'' are used? And what courses of actions can be taken in those cases?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
Probably not. Mere threats of death without an apparent present ability to inflict actual harm is usually not considered a violet act as decided in many Florida court cases. Name calling is not usually a criminal offense either unless it is one of the protected classes.
