Legal Question in Family Law in Florida

Post divorce property split

I was divorced 7 months ago with the divorce papers stating the house would be sold and the profit split 50/50. The house still has not sold and I have since moved out and am renting since it would have been impossible to live under the same roof as a divorced couple. He has not paid the mortgage in 2 months though telling me he did make the payments. The house is ready to be in default of the loan if the two months is not paid immediately. He has refused to make the payments which leaves me to pay my rent and the mortgage and all other living expenses. The real estate contract has now expired and he is refusing to put the house back on the market. What can I do to get the house listed and either get him to make the payments(as he is living there) or get out?

Your divorce agreement should state someplace that the parties will do what is necessary to implement the agreement. That includes signing a listing agreement to sell the house. You need to have the court enforce your divorce agreement. The court can compel your ex to put the house back on the market and to pay his share in the mean time.
