power of attorney

My husband is incarcerated & has given his father power of attorney. We have receive a jury award in a lawsuit. Is our attorney obligated to release half of the award to my husbands father?

There must be a dissolution pending. It appears you and your husband are not seeing eye-to-eye because he gave the POA to his father and not you. So there is a battle over the money, right? I agree his father is to hold the proceeds for your husband and not dispose of them, depending on the wording of the POA. Hard to tell without seeing the document.

It would depend on what the power of attorney says. Even if the power of attorney says that your husband's father can get the money, he can't just spend it, he has to protect the money on behalf of your husband.
