Legal Question in Family Law in Florida
would like to know what I can do to get power of attorney for my sister to sign legal papers on my behalf if something happened to me.also what kind of form can I get to sign paper to sign my son over to my sister if something happened to me.
1 Answer from Attorneys
It depends on what type of power of attorney you need. Many forms for power of attorney are available on the internet, but it's probably better to find an attorney. Most attorneys prepare power of attorney forms very cheaply, usually under $100.
If you pass away, custody of your son will automatically transfer to the other parent. You cannot prevent that, if it's an issue. If the other parent is deceased, you can provide for the custody of your child via a will. You and the other parent should have separate wills drawn up by an attorney which provide that your son will be in the custody of your sister should you both die.
