Pre-divorce mortgages and responsibilities

My husband is getting a mortgage to pay off my half of farm. I am to sign a quit claim at the closing of this loan today. We are not divorced yet, in fact things are very amicable. Yet I am concerned that I may be responsible for this loan, even if my name is not on the mortgage. If he defaults, can the mortgage company go after me or my credit?

I would strongly encourage to talk to your attorney ASAP for a legal opinion. In some circumstances it is possible to do as described and for you not to be held responsible in case of default.

Under the circumstances you describe, I do not believe you would have any financial libility, for the loan, should your husband default on the mortgage loan. Nonetheless you should review the matter with your attorney.
