Legal Question in Family Law in Florida

Pregnant

My boyfriend and I decided to bring a child into the world and at 6 months pregnant he kicked me out of his house. We are both military. I would like to know what kind of custody is automatically assumed if we do not go to court or petition the court for any sort of custody? (we live in the state of florida)

Re: Pregnant

As I understand your question in Florida the mother and father both have custody. However, I would suggest send me an e-mail and phone number and a time to call you to discuss the overall situation in greater detail. I look forward to speaking with you.

Re: Pregnant

In Florida, if the parents are not married, the mother gets primary custody (with visitation with the father) unless they otherwise agree or unless there is a dispute. If the father disputes this arrangement, as with divorcing parents, parents are entitled to shared custody and both can fight for full custody.

Re: Pregnant

Custody is shared, with one parent having the primary custody and the other shared custody with visitation rights. Normally it is recommended that you get a court order to determine who has primary custody and have the amount of child support set.
